The Wall Street Journal reported last weekend that according to the Administrate Office of the U.S. Court, lawsuits filed under the Family and Medical Leave Act (FMLA) increased from 877 in 2013 from 291 in 2012.
While the number of claims in 2013 remain relatively lower as compared to the 33,068 claims of race discrimination that were filed in 2013 with the Equal Employment Opportunity Commission, I believe that the increase indicates a heighted degree of awareness among employees regarding their leave rights. This article is a reminder to all employers to review and update their FMLA leave policies and procedures to avoid potential claims.
