Restrictive covenant law changes rapidly. Numerous recent court decisions in Wisconsin and other states have drastically impacted how employee restrictive covenant agreements are interpreted and enforced. Similarly, the federal government acted last year to institute changes to how trade secrets are protected under federal law by passing the Defend Trade Secrets Act. Whether representing an employer seeking to enforce a restrictive covenant or an employee (and new employer) seeking to avoid enforcement, counsel must be familiar with the current trends and challenges to enforcement. This presentation will focus on recent decisions affecting the interpretation of restrictive covenants, legislative reforms, pre-litigation considerations, and issues related to the threatened enforcement and enforcement of agreements in state and federal court.
