Intellectual Property & IP Litigation 2018 Year in Review

As we begin a new year, we are proud to reflect on the important matters our clients entrusted to us in 2018. We are thankful for the opportunities and partnerships we have with our clients and in our communities. Below is a sampling of representative matters that our team handled last year.   • Obtained a $14.5 million jury verdict for client DSM in a patent infringement lawsuit against Lallemand involving yeast technology for the biofuel industry.
  • Successfully invalidated a patent asserted against client American Orthodontics Corporation by competitor Dentsply in an IPR proceeding filed as a defensive response to a patent infringement lawsuit.
  • Efficiently resolved patent troll lawsuits, obtaining dismissals with no payments or settlement agreements in some cases.
  • Patent prosecution and portfolio management in various countries around the world for clients in a wide variety of technology areas including automotive, sporting goods, software, health technology, education, consumer goods, packaging equipment, toys and lighting.
  • Trademark portfolio management and counseling for many of Wisconsin’s most notable brands, including, for example, Kohl’s, Johnsonville, Schwinn and Duluth Trading Company.
  • Successfully resolved cancellations and oppositions concerning trademarks before the Trademark Trial and Appeal Board.
  • Diligence on large IP portfolios and negotiated IP provisions of numerous mergers, acquisitions and other corporate transactions cumulatively totaling billions of dollars, including an M&A Advisor Award finalist.
  • Drafted and negotiated complex agreements, including software, technology and other IP license and reseller agreements
  • Service to the bar, including on boards and committees for the Eastern and Western District of Wisconsin bar association (including current president), ABA, International Trademark Association, Wisconsin Intellectual Property Law Association, Madison Women in IP, the State Bar of Wisconsin and numerous community and nonprofit organizations.
