Godfrey & Kahn taps into its manufacturing experience to assist clients in Wisconsin and elsewhere who are shaping the renewable energy and energy-efficiency supply chain.

The Energy Strategies Group has worked with clean tech manufacturers that produce next generation clean energy products and components, including photovoltaic solar modules, commercial wind turbines, components for industrial scale wind turbines, and energy-efficient equipment.

Our cross-discipline Practice Group has advised clean tech manufacturers on all phases of their businesses, including structuring business activities, competitive positioning, applying for government incentives, securing debt and equity financing and protecting intellectual property. Clean energy manufacturers have also relied on our counsel for complex regulatory matters involving facility siting. The Energy Strategies Group has helped clients negotiate purchase and supply agreements that reflect sophisticated design requirements and clean energy certification and qualification standards.

The Energy Strategies Practice Group is on the leading edge of developments in governmental incentives for clean energy. We focus on identifying the most cost-effective ways for clients to incorporate renewable energy and significant energy efficiency projects into their energy/business portfolios. We have assisted clients in obtaining millions of dollars in competitive grand and other incentives and in strategies to maximize the value of tax credits and other incentives.

We provide federal and state grant-funding information and application drafting, including grants from federal agencies such as the Department of Energy, the Treasury Department, the Department of the Interior and the Environmental Protection Agency (EPA), and Wisconsin agencies, including the Department of Natural Resources and Focus on Energy. We frequently advise clients regarding tax incentives, including investment tax credits, and the beneficial depreciation deduction, and how to combine available various incentives for maximum value. We also help clients capitalize on new government initiatives to support clean energy and energy efficiency, such as Property Assessed Clean Energy (PACE) financing and Focus on Energy zero interest loans.

Alstom (Paris Stock Exchange: ALO)
Godfrey & Kahn represented Alstom, a global leader in energy and transport infrastructure, in the acquisition of certain assets of North American Phoenix Energy Services, Inc. and Phoenix Power Control, Inc., suppliers and servicers of control systems, power systems and other equipment for multiple energy markets, including hydroelectric, wind, solar and geothermal.

Godfrey & Kahn represented Alstom in their investment of up to $55 million in BrightSource Energy Inc., a specialist in designing, building and operating tower-based solar thermal power plants with operations in the USA, Israel and Australia

Franklin Energy Services, LLC
Godfrey & Kahn represents Franklin Energy Services, LLC, a Port Washington, Wisconsin based company that focuses on energy efficiency and renewable energy programs for utilities and states, in all of its business, real estate, regulatory and contract matters.

Mid-West Energy Research Consortium
A member of the Energy Strategies Practice Group is Chair of the Public Policy Committee for Mid-West Energy Research Consortium (M-WERC). M-WERC envisions that, through its efforts, the Midwest Region will become the leading region in the United States for the energy, power and control industries and will be known worldwide for its leading-edge research and technology development in these areas, resulting in innovative products, market leadership, employment opportunities, and vibrant technology transfer. The Mid-West Energy Research Consortium represents one of America’s largest clusters of energy, power and control companies, educational and research institutions, and other key industry stakeholders. M-WERC acts as a catalyst for the growth of these companies and industries, located in the greater Mid-West Region, through technology innovation, advanced research, market development, information sharing, workforce development, and strategic collaboration.

Permitting Wind Farm Manufacturing Facility
Godfrey & Kahn represented a fabricator of wind farm components to establish a new facility in Wisconsin. The facility required air permitting and a stormwater permit for new construction. With the assistance of technical consultants, Godfrey & Kahn successfully negotiated storm water and air permits for the facility.

Solar Development Company Client
Godfrey & Kahn provided all outside legal advice to solar development company that implements innovative projects utilizing technologies that combine solar hot water heating and solar photovoltaic (PV) cells.

Solar Development for Municipal and Governmental Entities
Godfrey & Kahn worked with developer to create strategies allowing it to develop solar projects for nonprofits, local governmental entities and other nontaxable entities that provide for the monetization of valuable investment tax credits and accelerated appreciation that can apply to solar projects.

Solar Manufacturer
Godfrey & Kahn represents a manufacturer of photovoltaic crystalline solar modules, in connection with the company’s formation and initial capital-raising activities. Godfrey & Kahn’s representation has included assisting manufacturer with a private placement of preferred securities and obtaining debt financing, along with organizational, real estate, employment and contract matters.

Solar Panel Production Facility
Godfrey & Kahn represented a developer of a planned several-hundred million dollar solar panel production facility with respect to siting and tax credit application issues.
