There is fast and furious action on the litigation front relating to the Environmental Protection Agency’s (EPA) controversial Clean Power Plan. Twenty-nine states and other interested parties have filed a lawsuit in the D.C. Circuit Court of Appeals challenging the Clean Power Plan. Last week, the D.C. Circuit denied the petitioners’ request for a stay of the EPA rule pending the appeal, and imposed an expedited schedule for briefing and oral arguments on the merits of the case. This week, the petitioners have filed a petition with the United States Supreme Court requesting the Court to issue a stay of the EPA rule pending a ruling by the D.C. Circuit on the merits of the challenges to the EPA rule.

On Feb. 10, Art Harrington of the Environment & Energy Strategies Practice Group will be speaking at a national American Bar Association (ABA) webinar on issues relating to this litigation surrounding the EPA’s Clean Power Plan. The ABA webinar will feature a panel of three experts on this topic. Art’s presentation will discuss the uncertainties that the litigation creates for the regulated utility sector, its customers, as well as states for implementing the complex substantive provisions of the EPA rule. The other speakers include Elbert Lin, the Solicitor General of West Virginia and Vickie Patton, General Counsel for the Environmental Defense Fund. The panel will be moderated by Lauran Sturm, Assistant General Counsel for the Tennessee Department of Environment and Conservation.
