Trusts, Wills & Estates

Overview | Attorneys

The firm offers sophisticated estate and trust planning and tax advice for its clients. The firm's Litigation Practice Group protects the intent of our estate planning clients against challenges to the distributive plan they have chosen. We regularly litigate competing claims to wills, trusts and charitable bequests, as well as claims by and against personal representatives and trustees relating to their administration. We also represent clients against the excessive imposition of taxes on their estates, income and property.

Examples of recent work include:

  • Representing the beneficiaries of a will that was challenged on grounds that the testator was mentally incompetent and that the beneficiaries exerted undue influence on the testator
  • Challenging a will based on the argument that it was revised only because of the testator's mistaken belief that her daughter had stolen from her
  • Analyzing the applicability of intestacy laws in connection with survival and wrongful death claims
