Trade and Professional Associations: A legal update for association executivesLaFollette Godfrey & Kahn Spring Seminar Series

Associations are affected by a variety of laws and regulations that apply to their unique operational and organizational structures. This presentation addresses the two areas that have a significant impact on associations.

Antitrust Law (Kevin O’Connor) - The relationship between antitrust law and associations is important and complex. Association executives must avoid activities that promote unlawful agreements and restraint of trade. We will discuss:

  • How unlawful agreements can be inferred from the activities of trade association members;
  • Basic rules to avoid liability under the laws; and
  • The need for an antitrust compliance policy and program.

Political Law (Mike Wittenwyler) - Since the U.S. Supreme Court announced in December its historic decision, McConnell v. FEC, several very significant legal developments are affecting an association’s political activities. We will discuss the latest legal issues, including:

  • Revenue Ruling 2004-06 and its effect on an organization’s lobbying activities;
  • The treatment of tax-exempt organizations as regulated political committees; and
  • State and federal regulation of issue advocacy communications in the 2004 election cycle.
