City of Milwaukee Paid Sick Leave Ordinance Update

Today, Milwaukee County Circuit Court Judge Thomas R. Cooper granted a temporary injunction staying the February 10, 2009 implementation date of the City of Milwaukee Paid Sick Leave Ordinance ("Ordinance"). The injunction means that employers will not need to begin tracking employee hours and accruing or providing paid sick leave to employees as required by the Ordinance for the duration of the injunction.

This injunction was sought by the Metropolitan Milwaukee Association of Commerce ("MMAC") in its legal challenge seeking to invalidate the Ordinance. 9to5 National Association of Working Women, an intervenor defendant in the case, has indicated that they will not appeal the Judge's decision granting the temporary injunction to MMAC. As a result, the injunction should last for the duration of the litigation in front of Judge Cooper.

Further arguments on MMAC's motion for a permanent injunction and declaration that the Ordinance is invalid as a matter of law will be heard by Judge Cooper on May 11, 2009.
