IRS Community Benefit Survey Begins

Tax-exempt hospitals are in the midst of an IRS "compliance check" regarding their community benefit activities. The IRS is sending Form 13790 to approximately 600 tax-exempt hospitals across the United States to inquire about hospital community benefit programs and governance. There are 72 questions that concern the provision of charity care, emergency room operations, patient demographics, the hospital’s governing board, medical staff privileges, medical research activities, professional education, billing and collection practices and community outreach.

In addition, the questionnaire includes nine questions on compensation practices as applied to "disqualified persons," such as voting board members and certain officers. The health law attorneys at Godfrey & Kahn can provide advice and help your hospital complete Form 13790 from the IRS.
