Statutory Change: Wisconsin Reporting Requirements for Non-resident PACs

As a nonresident political action committee publicly-registered with the Wisconsin Elections Board, your organization should be aware of 2005 Wisconsin Act 176 and the change it makes in state reporting requirements. A copy of the new law, signed by the Governor last week, is enclosed.

Under current law, a nonresident PAC registered with the Elections Board is only required to report its contributions from Wisconsin donors and its disbursements to Wisconsin candidates, political parties and other political committees. There is no further disclosure required to the Elections Board for the nonresident PAC and its non-Wisconsin activity.

Under the new law, however, a nonresident PAC will be required to disclose all contributions ($20+) to the nonresident PAC and all disbursements ($20+) by the nonresident PAC. Accordingly, a report will be required of all the activity by the nonresident PAC, regardless of where the activity occurred.

The first report affected by the new law will be the Fall Pre-Primary Report due on September 5, 2006.
