Document preservation, legal holds and spoliation: Ethical implications and practical solutions 

The presenter will identify specific professional ethical obligations governing the retention and preservation of documents within corporate IT systems and on social media. The discussion will then focus on compliance strategies for: Determining when a duty to preserve documents arises; the issuance of legal holds; and avoiding the adverse impacts of spoliation in litigation – all within the context of in-house counsel’s ethical obligations to their companies and the profession.
