Refinancing and Reorganization
Our attorneys collaborate with companies facing insolvency to identify and execute the most strategic course of action, including negotiating financing and creditor adjustments, and guidance through bankruptcy. Our representative experience includes:
- Food Industry – Our counsel through Chapter 11 helped a large company with labor problems and a history of losses concentrate on its core meat processing business, settle its labor dispute, and emerge as a profitable, growing employer.
- Business Support Industry – Our team helped a telemarketing company being forced into liquidation to pursue reorganization. We won against the client's commercial bank, negotiated a payment plan with other creditors, and raised cash by selling off unprofitable lines of business. We also helped to settle the claims of a venture investment group. The client became profitable and the bank was paid in full. Several years later, the company's owners sold the business for a healthy return.
Our Practical Approach to Bankruptcy Issues
Our experienced team works with companies involved in the bankruptcy process to minimize losses and preserve value. Our business-minded approach helps mitigate your distress while seeking the most desirable outcomes. Our representative experience includes:
- Commercial Property Owner – Our team counseled a business with poor cash flow from a warehouse property on resolving issues with its tenant, who had filed for bankruptcy. With our guidance, the client was able to sell the property and recover sufficient cash from the tenant's bankruptcy estate, covering all actual damages. We also helped the client recover a portion of projected future rents.
- Manufacturer – Our client was sued by the East Coast bankruptcy trustee of a former customer for recovery of a large preference. In reviewing the account history with our client, we quickly discovered the trustee had ignored crucial information in computing the alleged preference. We negotiated dismissal of the complaint without having to retain local counsel or prepare elaborate pleadings.
