Hiring in the Midst of a Labor Shortage: Creative Solutions and Employment Law Considerations

In February 2022, the U.S. had 1.8 open jobs for every one unemployed person, which Federal Reserve Chair, Jerome Powell characterized as a “very, very tight labor market – tight to an unhealthy level.” All signs currently point to this trend continuing indefinitely. In this context, employers across all industries are thinking creatively and testing out new strategies to attract and retain workers. However, when employer creativity collides with inflexible employment laws, new recruitment and retention strategies can create increased legal risks. This presentation will briefly examine three popular employer recruitment and retention strategies, highlight some of the associated legal risks, and offer practical guidance to mitigate those risks.

Mental Health & Workplace Accommodations: Navigating unique issues and legal obligations

What do USA Gymnast Simone Biles and $10B startup company EarnUp CEO Matthew Cooper have in common?  In addition to being wildly successful in their fields, they both have publicly disclosed the toll mental health issues have taken on their personal and professional lives. Mental health issues are not new, but in recent years mental health issues have moved to the forefront of the conversation. Employers are being forced to learn and adapt to the accommodation challenges created by medical conditions that may not be visibly identifiable and often manifest differently among employees depending upon the time, place and circumstance.

In this presentation, we will explore employers’ obligations under the ADA to provide reasonable accommodations to employees with mental health conditions. We will also provide practical tips for managing accommodation requests and unique issues that arise in connection with employee health conditions through discussion of scenarios based on recent case law and commonly asked questions by clients.
