Disability discrimination compliance strategies: Addressing intermittent leave and other accommodation requests across generations

2:00 – 2:40 p.m.

This session will focus on how corporate counsel can help address employee accommodation request challenges, while anticipating current and future generational trends. The ADA, WI Fair Employment Act and EEOC Enforcement Guidance will be covered, as well as emerging accommodations with issues such as depression, anxiety, and Alzheimer's.


Attorney-client privilege and work product waiver: What every in-house counsel should know about preserving confidentiality

presented by Art Harrington and Brian Spahn

Companies are increasingly outsourcing tasks and projects previously handled by in-house counsel. Companies routinely engage third-party consultants to assist with a variety of regulatory and compliance issues. The attorney-client privilege and work product doctrine are often implicated in communications with people outside of the company or firm. Oftentimes the issues a third-party consultant is asked to address include highly sensitive matters that the company will prefer not be made public. As a result, in-house counsel need to consider steps to protect from discovery the communications and work product generated through these third-party arrangements.

This presentation will use hypothetical situations to address important considerations and exceptions to third-party attorney-client privilege and work product waivers. The program will discuss the scope and applicability of waiver exceptions as well as best practices in-house counsel can employ when working with third-party consultants.

Advertising law: What in-house counsel need to know about the legal and regulatory scheme in advertising law

All sophisticated businesses advertise or publish content that is subject to the laws of advertising, which are drawn from several different statutory and regulatory schemes. This presentation will provide an overview of the legal and regulatory scheme relevant to advertising laws as well as topics that all in-house counsel should be aware of, including ownership of third party content, social media issues, recent developments and tips.


Cybersecurity and privacy law doubleheader: An update on trending legal issues followed by a panel discussion about cybersecurity due diligence in M&A

presented by Mark Shelhart (Sikich), Matt Kovacich

4:05 – 5:00 p.m.

How are courts handling cyber liability insurance disputes? What new cases and laws are important for in-house counsel? How do you use recent data security fails to strengthen your own due diligence efforts? This two part session will provide answers to those questions and much more. Part One will provide an update on recent cybersecurity and privacy law issues that should be on every corporate counsel’s radar. In Part Two there will be a panel of experts with individuals from Godfrey & Kahn and Sikich. With both technical and legal knowledge, the panel will discuss how the lessons learned from recent breaches can be leveraged to achieve better cybersecurity due diligence in mergers and acquisitions and vendor risk assessments.
