This session will explore the Great Wealth Transfer and its direct impact on trust company operations and business models. We will survey how banks and trust companies can adapt to meet the changing needs of next-generation beneficiaries, along with potential strategies to modernize service delivery and retain assets during this historic generational shift.
“The Trust Is Sitused Where?!”
50 minutes — Andrew Benson
Over the past few decades, states have adopted significant changes to their laws regarding trust administration and taxation. As a result, estate planning techniques that seek to take advantage of those changes have become increasingly popular in different states. This raises conflict of laws issues. In 2026, we expect to see proposals for two overhauls of the conflict of laws for trusts. We will discuss the existing conflicts of laws regime and the changes we expect to see in the not-too-distant future.
Mitigating Litigation Risk
50 minutes — Jonathan Ingrisano and Hunter Van Asten
Litigation and court petitions have become an inevitable reality for professional fiduciaries. The session will go beyond best practices for file documentation and preserving privileges to implementing pre-filing strategies that can best position trustees for successful outcomes in court.
Fiduciary Litigation Update
50 minutes — David Konkel and Xavier Jenkins
The 2026 litigation update will cover recent changes and developments in trust and estate litigation, with an emphasis on Wisconsin and other Uniform Trust Code jurisdictions.
