Fiduciaries face an increasingly complex legislative, regulatory, and judicial landscape. We see an upward trend in disputes over undue influence and client capacity, as well as issues on the horizon that involve data privacy and cybersecurity in an increasingly interconnected and technology-driven society. This program will help planners identify and respond to undue influence and incapacity to help avoid some of the most common disputes that arise from planning and administration of trusts and estates, and will introduce the key concepts and best practices recommended by cyber security professionals.
This program will review the legal framework for undue influence and incapacity claims to better avoid disputes during planning and administration of trusts and estates. The latest cybersecurity best practices in estate planning and administration will also be covered.
