USCIS Ends Automatic EAD Extensions for Filings After October 30, 2025

United States Citizenship and Immigration Services (USCIS) announced today that, effective October 30, 2025, timely filed Employment Authorization Document (EAD) extension applications will no longer be eligible for the 540-day automatic extension currently available to certain categories of EADs. USCIS is issuing an Interim Final Rule (IFR) tomorrow (October 30th) that will make this change in policy and procedure effective immediately. Any EAD extensions filed prior to October 30th will not be impacted by this change and would still be eligible for the 540-day extension if they qualified under the prior regulations. However, going forward, the automatic extensions of EADs in eligible categories is ending. There are very limited exceptions to this rule, including extensions provided by law or through a Federal Register notice for TPS-related employment documentation. USCIS will be updating its website and other documents at I-9 Central to reflect this change.
