At the end of the Summer of '24, the Supreme Court’s decision in Loper Bright v. Raimondo upended the decades-old Chevron deference. This decision removed the judiciary's obligation to defer to federal agencies' interpretations of ambiguous statutes.

But where are we now? And how is any of this going to impact cyber, privacy and risk? 

Agencies like the FTC, SEC, and CISA may face increased challenges to their interpretations of ambiguous regulations, leading to heightened litigation, slower rulemaking, and more uncertainty for businesses. Ms. Sullivan will steer the discussion around this noteworthy and evolving court ruling, provide the latest examples of shifts in regulatory enforcement and suggest strategies for mitigating risk in a post-Chevron world.
 

Back in My Patchwork Era: Revisting a Risk-Based Approach to Privacy Compliance
