Court Petitions and NJSAs: Creative Problem Solving After the Trailer Bill

Ryan Van De Hey and Jonathan Ingrisano talk litigation avoidance and creative problem-solving. Last year’s Trust Code amendments made multiple changes that add to Wisconsin trustees’ ability to address problematic trust scenarios (and beneficiaries) and preempt contentious litigation. Those amendments also facilitate beneficiaries’ use of NJSAs in scenarios that often require trustees’ proactive response. Attendees will also explore the estate, GST, and income tax consequences of early trust termination, with a focus on recent IRS Private Letter Rulings that reveal how overlooked income tax consequences, particularly at termination, can trigger significant and unexpected liabilities. The session will highlight practical strategies for trust planning, gifting, and liquidity event preparation in today’s shifting tax landscape.
 

AI, Digital Assets and Cybersecurity: Technology Challenges Facing Fiduciaries
